Three weeks after the murder conviction was overturned, prosecutors dropped charges against Adnan Syed, the subject of the popular podcast Serial.
A lawyer with knowledge of the lawsuit said it followed further DNA testing.
Mr Saeed, 41, was sentenced to life in prison in 2000 for the alleged murder of his girlfriend, Lee Hae Min. He was 18 at the time.

After his release, Mr Saeed was placed under house arrest and under GPS surveillance.
Circuit Judge Melissa Phinn gave prosecutors 30 days to retry him or drop the charges.
On Tuesday, the Baltimore City State Attorney’s Office confirmed it had dropped the indictment against him.
Laura Nirider, a lawyer who accompanied Syed when he was released from prison last month, said Syed was “officially innocent”.
Nirider, co-director of the Wrongful Convictions Center at Northwestern Pritzker Law School, tweeted: “Update: The latest round of DNA testing produced the same results as previous rounds, ruling out Adnan Syed, who is now officially innocent! “

Court documents were filed last week in support of Ms Lee’s family’s appeal.
Lawyer Steve Kelly said while they did not challenge Mr Syed’s release, they wanted the judge to hold another hearing so they could speak in court.
Mr Syed, who has maintained his innocence for decades, brought public attention to the series’ inaugural season in 2014.
Some of the evidence used in his case has been questioned, including data from cell towers.
Prosecutors said the other suspects were known at the time of the initial investigation and were not properly excluded or disclosed to the defense.
They added that new information revealed that one of the suspects was convicted of serial rape and sexual assault.
